Defamation Act (Northern Ireland) 2022 — what it left out, and why that helps
The 2022 Act received Royal Assent on 6 June 2022. It brought Northern Ireland partly into line with England and Wales: it codified the defences of truth, honest opinion and publication in the public interest, removed the presumption in favour of jury trial, and amended the law of privilege.
But two of the 2013 Act’s most significant provisions were deliberately not carried across, and both work in favour of someone who has been posted about.
There is no serious harm test. England and Wales require a claimant to show that publication caused, or was likely to cause, serious harm to reputation before a statement is actionable. Northern Ireland does not. The threshold for establishing defamation therefore remains lower here than anywhere else in the UK — which matters most for exactly the kind of post that reaches hundreds rather than hundreds of thousands of people.
There is no single publication rule. England and Wales adopted one in 2013, so the limitation clock starts at first publication and reposting does not restart it. Northern Ireland retained the multiple publication rule, meaning a fresh cause of action accrues each time the material is downloaded or accessed within the jurisdiction.
That second point is the significant one for AWDTSG content. A post that has been sitting in a group for two years, still visible and still being viewed, is in a materially stronger position in Northern Ireland than the equivalent post in England, where it would likely be out of time. Content that is still online is, in effect, still being published.
The 2022 Act also omitted an equivalent to s. 5 of the English Act, which provides a defence for website operators.

Intimate images in Northern Ireland
The Online Safety Act 2023 offences at s. 188 extend to England and Wales. Northern Ireland has its own provision — s. 51 of the Justice Act (Northern Ireland) 2016, which makes it an offence to disclose a private sexual photograph or film without consent and with intent to cause distress.
Because the regimes were written separately, the tests are not identical to the current English position, and a submission built on the English offence is built on the wrong law. Where an AWDTSG post includes an intimate image and the person depicted is in Northern Ireland, this is the applicable provision. Given the pace of reform in this area across all three UK jurisdictions, this is a point worth confirming with local advice at the time.

UK GDPR, Article 17
Data protection is reserved, so Article 17 applies in Northern Ireland exactly as elsewhere in the UK. Where a post contains your personal data, an erasure request can be made to the platform as data controller, supported by the Data Protection Act 2018 and enforced by the Information Commissioner’s Office.
